Terms and Conditions 

a) Before using this site, carefully review these Terms and Conditions. By using this Website and/or registering for the Services, you provide your electronic signature to these Terms & Conditions. 
b) For any inquiries, please contact us. Throughout this agreement, you are referred to as the "user”, and professionals (including Lawyers, Chartered Accountants, Tax Consultants, etc.) providing the services are referred to as “Experts.” 
c) By continuing, you affirm that you are at least 18 years old and competent to accept these terms. Minors must have a parent or guardian accept this Agreement. 

 

2. Using the CallmyCA Website  
a) Users are responsible for submitting accurate information. Additional information may be requested as needed. 
b) The materials and information provided on the Site do not necessarily reflect the views of the Experts. The Site's information is not guaranteed to be accurate or complete. 
c) Your relationship with an Expert or Expert’s Firm is solely between you and them. CallmyCA is not liable for any damages arising from this relationship. 
d) Experts are committed to serve you under the following condition that Users must possess basic internet skills to use the services. 
e) At CallmyCA, we're dedicated to supporting your Consulting and Advisory needs. Our tagline, "Your Consultants and Advisors, just one call away!" reflects our commitment to providing timely assistance whenever you require it. 
f) It's important to clarify that the initials "CA" in CallmyCA stand for "Consultants and Advisors" and we specifically mean "Consultants and Advisors" and nothing else. We want to ensure there's no ambiguity  regarding this. We strive for clarity and do not have any intention to mean anything else. 
g) Our platform welcomes a diverse array of professionals, including tax consultants, lawyers, Chartered Accountants, and more.  
h) By using CallmyCA, you agree to these terms regarding the definition of our name and tagline. We appreciate your trust and eagerly anticipate assisting you with expert advice and support whenever you need it. 

3. How It Works 
a) Opting for a Paid Service at CallmyCA incurs a fee. This fee is paid to the Expert and serves as compensation for their time in providing services and includes CallmyCA's technology maintenance and operational costs. 
b) The fee for paid services is specifically for the defined scope of services offered during the booking.  
c) It's important to note that CallmyCA does not solicit, endorse, or promote any individual listed on the website. We do not accept liability for decisions made based on such information. 
d) While listing on CallmyCA may enhance an Expert's exposure, we're not an advertising portal driven by fees. Our search and sort functionality relies solely on user-entered information and our algorithm. We do not endorse any individual described herein and accept no liability for decisions made in reliance on such information. 

4. Right to Modify Terms of Service  
a) You acknowledge and agree that the Terms of Service may be amended periodically without prior notice. It is your responsibility to stay updated with the latest version available on the CallmyCA website.  
b) Any revisions or changes will be immediately binding upon release of the updated Agreement or modification to the Service(s) on our website. Unless stated otherwise, these terms supersede any other terms associated with the Services. 
c) CallmyCA reserves the right to discontinue service or deny access to individuals who violate our policies or the terms and conditions outlined herein, without prior notice. 
d) Furthermore, CallmyCA retains the right to freely transfer, assign, or delegate all or any part of this Terms of Use, along with any rights and duties herein. This Terms of Use will remain binding upon the parties' heirs, successors, and permitted assignees. 
5. Independence of Professionals 
a) The consultations provided by Experts via CallmyCA represent their individual and independent opinions, not those of CallmyCA or its affiliates.  
b) CallmyCA does not endorse specific Experts, products, procedures, or opinions mentioned on the platform. 
c) CallmyCA functions as a technology platform to cater to User’s various financial needs. 
d) While Experts provide basic information to CallmyCA, we do not independently verify this information and do not guarantee the qualifications of any Expert. CallmyCA is not directly or indirectly responsible for the consultations provided by listed Experts.  
e) Any issues or discrepancies with the services provided by Experts are not the responsibility of CallmyCA. 
f) You agree that any claims arising from your relationship with an Expert or Expert’s Firm shall be directed solely against such Expert or Expert’s Firm. CallmyCA aggregates legal service demand for listed Experts and their Firms, and thus shall not be involved in any such claim. 
6. CallmyCA as a Medium for Interaction 
a) CallMyCA is an internet portal facilitating communication between Experts and potential service users. It serves as a platform for the exchange of information.  
b) However, CallMyCA does not guarantee successful connections between users and Experts, nor does it determine when or if an Expert-client relationship is established. 
c) To maintain an optimal forum, CallMyCA does not intervene in agreements between Experts and clients or in client representation. Consequently, we cannot ensure the completion of agreements or the integrity of either party.  
d) Users are solely responsible for assessing the integrity, honesty, and trustworthiness of all communication partners on this service. CallmyCA is an independent third-party enabler, providing a platform for clients to communicate with Experts.  
e) We do not control the services provided by Experts and are not responsible for any issues or discrepancies that may arise. 
f) We reserve the right to publish free advice provided to clients on our portal and in external communications for knowledge sharing. However, user details will not be displayed in any published content. 
g) Users are strongly advised against mentioning any individual or entity names in their queries to avoid potential defamation liabilities. 
h) While we have multiple Experts in the same practice area, differing opinions may arise. CallmyCA does not accept liability for these differences and encourages users to seek additional opinions or decide based on merits and logical conclusions. 

7. Scope of Services 
a) CallmyCA, including its owners, employee staff, and third-party professionals, disclaims responsibility for any medical, legal, or financial outcomes related to services obtained through the Website.  
b) We do not guarantee that web-based, phone, or in-person/video consultations are suitable solutions for specific problems. 
c) CallmyCA reserves the right to maintain, delete, or destroy all communications and materials posted on the Service according to its internal record retention policies. 

8. Membership Terms for Experts 
a) Representation and Warranty: You affirm that you are at least eighteen years old and possess the legal right and ability to enter into agreements regarding Terms & Conditions, register on CallmyCA Services under your name, and use the Services in accordance with the Terms & Conditions. You are responsible for maintaining the confidentiality of your password and must immediately report any unauthorized use or security concerns to  CallmyCA. 
b) Prohibited Activities: You are prohibited from posting advertisements, soliciting user, reproducing website content for commercial purposes, or using any disruptive devices. In the event of damages resulting from such conduct, you agree to pay liquidated damages and any further unquantified damages. 
c) Disclaimer of Professional-Client Relationship: CallMyCA facilitates communication between Experts and potential clients but does not create a Professional-client relationship. The decision to form such a relationship is solely between the user and the Professional. Users may be contacted by telephone or email as per this 
Agreement and Privacy Policy. 
d) Promotion and Solicitation: CallMyCA does not promote any user and does not constitute legal advice. Users are encouraged to independently study Expert profiles and make informed decisions. CallMyCA does not provide avenues for solicitation and protects client information from Experts until direct communication occurs. 

9. Legal Advice Disclaimer 
a) Non-Provision of Legal Advice: CallMyCA does not offer legal advice. The information provided in the 'FAQs' section is not equivalent to legal advice; it merely addresses commonly asked questions about various legal documents. Users seeking specialized guidance on these matters are advised to consult with Experts. 
b) Waiver and Severability of Terms: Our failure to enforce any right or provision of this agreement does not waive such rights. If any provision of the agreement is deemed invalid by a court, the parties agree that the court should strive to uphold the parties' intentions reflected in the provision. Other provisions of the agreement will remain in full force and effect. 
c) User Responsibility and Risk: Your use of the CallmyCA Services is at your own risk, and you assume full responsibility for associated risks. Moreover, we do not exercise editorial control over third-party content appearing on CallmyCA. 
d) Content Disclaimer: All information, products, or services provided through CallmyCA are offered 'as is,' without any warranty, express or implied, to the fullest extent permitted by law. We disclaim all representations and warranties, including but not limited to merchantability, appropriateness, title, non-infringement, and freedom from viruses. 
e) Third-Party Content and Hyperlinks: We are not responsible for third-party content on the Website or accessible via hyperlinks. We do not endorse or control third-party websites or their associated products/services. Any dealings with advertisers found on the Website are solely between you and the advertiser. 
f) Service Reliability and Interruptions: We make no warranty regarding the reliability, accuracy, or completeness of CallmyCA products and services. Temporary interruptions in service may occur, and we shall not be liable for any resulting losses or expenses. We do not guarantee that the Services will meet your requirements or be uninterrupted, timely, secure, or error-free.

All information submitted to us is at your sole risk, and we are not liable for any loss of information. We do not warrant that the Website will be error-free, free of viruses, or that defects will be corrected. We do not guarantee that any service or goods associated with the Website will be error-free or uninterrupted. Any material obtained through the service is at your own risk, and we are not liable for any damage to your 
computer system or loss of data. 
c) Disclaimer of User Representations: CallMyCA does not represent, guarantee, or warrant the legal ability, competence, or quality of representation provided by any Experts or Expert’s Firms listed on the site. We are not an Expert’s Firm and do not provide legal advice. Users are encouraged to consider multiple sources and make informed decisions. 
d) Information Accuracy and Expertise: While we strive to keep our content accurate and up-to-date, we cannot guarantee that all information is current due to changes in laws and regulations. Legal requirements may vary by location, and our general information may not apply to every situation. Your use of our sites and services does not create an Expert-client relationship. 
e) Users of CallMyCA are granted a nonexclusive, limited right to access and use the service in accordance with the rules outlined in this contract. To maintain the attractiveness and utility of the system, users must adhere to these rules. CallMyCA reserves the right to deny access to any user who violates these rules, receives complaints from other users, or for any other reason. 

11. Prohibited Activities: Users are prohibited from engaging in the following activities: 
a) Use of foul or inappropriate language. 
b) Making racist, hateful, or otherwise offensive comments. 
c) Promoting or providing instructions for illegal activities, or advocating physical harm or injury against any individual or group. 
d) Defaming any person or group based on age, race, religion, or nationality. 
e) Violating the intellectual property rights of others, including copyright, trademark, patent, or trade secret infringement. 
f) Violating Internet standards. 
g) Displaying harassing, abusive, threatening, harmful, vulgar, obscene, or tortuous material, or invading others' privacy. 
h) Interfering with or disrupting the service or servers connected to the service, including posting advertisements or links to competing services, sending "junk mail", "spam", "chain letters", or engaging in unsolicited mass distribution of e-mail. 
i) Compromising the security of the service provided by CallMyCA, including attempting to gain unauthorized access to system areas or other users' private information. 
Copyright Infringement: Users who believe that materials accessible on or from CallmyCA infringe their copyright may request the removal of those materials by contacting us. 

12. Disclaimer of Information Obtained on the Service and Some User-Supplied Content 
a) Information Accuracy: CallMyCA serves as a platform connecting Experts with individuals seeking legal assistance. While we strive to provide accurate and up-to-date information, we do not guarantee the correctness, completeness, or adequacy of the content on our website. Users should exercise caution when relying on information obtained from CallMyCA. 
b) Links and Endorsements: Links provided on our website to external sites are not endorsements or affiliations with those entities. CallMyCA does not endorse the contents of linked websites and assumes no responsibility for their accuracy or completeness. 
c) User-Submitted Content: Opinions expressed by individual users on our platform are their own and do not necessarily reflect those of CallMyCA. User-submitted data is not verified before appearing on the website, so users should use caution when using this information. 
d) Expert Verification: While CallMyCA makes efforts to verify the standing of experts listed on our platform, we cannot guarantee their status or abilities. Users are encouraged to conduct their own investigation and evaluation of experts before engaging their services. 
e) Caution Regarding Specialization Claims: CallMyCA does not endorse claims of specialization or limitation of practice by experts listed on our platform. Users should verify the accuracy of such claims and exercise caution when relying on them. 
f) Monitoring and Endorsement: CallMyCA does not endorse the content or legality of any offers, statements, or promises made by experts or other parties on or off our site. Users should use discretion and diligence when interacting with experts and other parties. 
g) Indemnification: Users agree that CallMyCA is not liable for any harm resulting from their use of the service. indemnify and hold CallMyCA harmless from any liability, costs, claims, demands, damages, and expenses arising from or related to their use of the service, including any breaches of the agreement. This indemnity applies to legal fees and costs and extends to CallMyCA, its founders, officers, experts and employees. CallMyCA reserves the right to assume control of defense and settlement of any matter subject to indemnification by the 
user. 
h) Loss of Data: CallMyCA is not responsible for any loss of data due to accidental or deliberate deletion, network or system outages, backup failure, file corruption, or other reasons. 
i) Linking to CallMyCA: Users may link to the CallMyCA homepage as long as they do not obscure any portion of the homepage and discontinue providing links if requested by CallMyCA. 
Advertisers: CallMyCA may contain advertising and sponsorship, and advertisers and sponsors are responsible for ensuring the accuracy and compliance of their materials with applicable laws. CallMyCA will not be liable for the legality or accuracy of advertisers' or sponsors' materials. 
j) Disclaimer of Warranties and Limitation of Liability: CallMyCA emphasizes that users must accept responsibility for their own actions and not hold CallMyCA accountable for the actions of other users. Users agree that CallMyCA shall not be liable for any damages, including direct, indirect, incidental, special, or consequential damages, resulting from the use of the service, interruption, suspension, or termination of service, or unauthorized access to or alteration of user data, even if advised of the possibility of such damages. 
k) Arbitration: Any dispute or claim arising from this Agreement or CallMyCA services shall be settled by binding arbitration in accordance with the laws of India. The arbitration shall be conducted on an individual basis and not consolidated with any other party's claim. Legal disputes will also be decided according to Indian law, with the courts of Jaipur having jurisdiction. 
l) Entire Agreement: This agreement represents the entire agreement between the user and CallMyCA, superseding all prior communications regarding its subject matter. It replaces all prior understandings or 
agreements, written or oral. Users who find these terms unacceptable should not use the site. CallMyCA reserves the right to revise these terms without notice, and users are responsible for reviewing them 
periodically. 

13. By using CallMyCA services or accessing the site, users acknowledge that they have read and agreed to these terms and conditions. 
a) Electronic Payment: CallmyCA may engage third-party payment service providers, including banks, to facilitate payments between users (buyers and sellers) and for collecting platform fees and other charges. These providers could include banking or credit card payment gateways, payment aggregators, cash on delivery services, mobile payment providers, or any other authorized facility by the Reserve Bank of India. 
b) Users acknowledge that the bank/debit/credit card details provided for CallmyCA services must be correct and 
accurate. These details are entered directly on the third-party payment service provider's webpage, and CallmyCA does not have access to this information. 
c) Users' use of third-party payment service providers is subject to their respective terms and conditions. CallmyCA disclaims responsibility for the behavior, features, or content of any third-party payment service provider. 
d) CallmyCA cannot assist with stop payment requests for payments scheduled using a payment account credit/debit card. Users must directly contact their credit/debit card company or bank in such cases. 
e) Payment, Cancellation & Refund Policy: Payment Policy: All fees must be paid upfront before availing any paid service at CallmyCA. 
f) Cancellation Policy: Cancellation of any paid consultation must be notified to CallmyCA, and cancellation charges will be effective from the date of receipt of the cancellation email. 
g) Cancellation can be requested no later than 24 hours before the final delivery time or appointment time. 
h) Refund Policy: If a consultation request is accepted but later rejected or canceled due to unexpected circumstances, users will be given the option of opting for another consultation request or receiving a complete refund. 
i)Refunds will be credited to the user's account within 45 working days. If a user's payment account is accidentally overcharged, CallmyCA will refund the outstanding amount within 45 
working days. 
j) If the transaction amount is less than the actual fee amount, CallmyCA will debit the outstanding amount from the user's payment account. 
k) Users must maintain unique transaction ID numbers provided at the time of placing a request. 
l) Refunds are subject to a nominal deduction of upto 25% towards online payment processing. 
m) Refunds are only provided for the professional fees component of the charges paid by the user. 
n) Upon confirmation of the refund request, users will be asked to provide bank account details for processing. 
o) Liability Disclaimer: CallmyCA and its affiliates disclaim liability for any direct damages exceeding the purchase price and any special, punitive, indirect, incidental, or consequential damages, including personal injury, loss of use, loss of profits, interruption of service, or loss of data, arising from the use of the website or services. 
q) These provisions are for the benefit of CallmyCA and its affiliates, who have the right to assert and enforce them directly against users. 

14. Professional Ethics Notice:If you are an Expert/Professional participating in any aspect of the CallmyCA website, you acknowledge that rules of professional conduct apply and commit to abiding by them. These rules include regulations concerning advertising, client solicitation, unauthorized practice of your profession, and factual 
misrepresentations. CallmyCA disclaims responsibility for your compliance with these rules. 

15. Ownership of Content: By submitting any query, you agree that your Query and any provided answers by an Expert/Professional become part of CallmyCA's public database and its sole property. CallmyCA will own all rights to submitted questions and answers, including intellectual property and moral rights, without compensating you. CallmyCA has the unrestricted right to use, reproduce, edit, modify, sell, adapt, publish, translate, create derivative works, distribute, communicate to the public, perform, and display the content worldwide. 

16. Off-Boarding: Breach of the agreement may result in immediate suspension or termination of the Expert/Professional's Callmyca account, with or without prior notice. 

17. Reporting: Clients are encouraged to report any request for personal contact details from a Expert/Professional to Callmyca immediately. Similarly, Legal Professionals must report any unsolicited provision of personal contact details by a Client. 

18. Waiver of Rights: The failure of CallmyCA to exercise or enforce any right or provision of these Terms & Conditions does not constitute a waiver of such right or provision.  

19. Electronic Signature: Your affirmative act of using the CallmyCA Website or registering for the Services constitutes your electronic signature to these Terms & Conditions and Privacy Policy. By doing so, you consent to enter into agreements with CallmyCA electronically, and the Privacy Policy is deemed to be part of these Terms & Conditions. 

20. User Acknowledgment:  
a) Users acknowledge and understand the risks and benefits of online consultation provided by CallmyCA. Users agree to assume the associated risks and limitations. No warranty or guarantee is made regarding the outcome of consultations. 
b) Users understand that consultations may involve electronic communication of personal information to Experts in different locations, including out of state. 
c) Consent to Communication: Users express their consent to receive communication, including commercial communication, related to CallmyCA services, even if registered with the National Do Not Call Registry. Such communication will not be considered Unsolicited Commercial Communication under TRAI guidelines. 
d) Notice: CallmyCA may provide notice to Users via email to the address provided during registration or through a general notice on the website. Users can give notice to CallmyCA via email. 
e) Assignment: CallmyCA reserves the right to assign this contract to any parent, subsidiary, or affiliated company, or as part of a sale, merger, or transfer of the company. Users will be notified of any change in ownership, allowing them to discontinue use if desired. Users may not assign, transfer, or sublicense these Terms of Use to anyone else.
