In a significant move aimed at simplifying tax compliance, the Government is planning to introduce a new provision that could allow taxpayers to claim a TDS refund without having to file an Income Tax Return (ITR)

This recommendation is part of the review of the upcoming Income Tax Bill 2025 and could be a game-changer for individuals earning below the tax threshold.

✅ No More Mandatory ITR Filing for TDS Refund?

Traditionally, even if your income was below the taxable limit, filing an ITR was mandatory to claim a TDS refund, even if TDS was wrongly or unnecessarily deducted. For many small taxpayers, this meant going through a complex & often intimidating ITR process.

But now, the government is considering allowing eligible individuals to submit a simplified form instead of a full ITR, making it easier to recover the deducted tax.

🆕 What Is the New Rule?

Under this proposed mechanism, taxpayers will not be required to file a full ITR to get their money back. Instead, the refund process will be handled via a streamlined form, entirely based on the TDS data already available in Form 26AS.

This initiative will be handled by the Central Board of Direct Taxes (CBDT), which is currently working on finalising the structure of the form and setting up the digital process."

👥 Who Will Benefit the Most?

This change is designed specifically for:

  • Individuals earning below the basic exemption limit
  • Senior citizens
  • Students or part-time earners
  • Small depositors who earn nominal interest income but get TDS deducted

In short, any taxpayer not legally required to file returns, yet struggling to get a refund due to unnecessary TDS deductions, will benefit from this new rule.

🔍 Key Advantages of the New TDS Refund Rule

  • No ITR Filing Required: A major relief for those who file ITRs only to claim refunds
  • Time-Saving: No more complicated forms or documentation
  • Hassle-Free Refunds: Simply submit the simplified form & track your refund
  • Faster Processing: With automation and Form 26AS integration, refunds will likely be disbursed quickly

📅 When Will the Rule Be Implemented?

While the announcement is promising, the proposal is still in its implementation stage. It is expected to be part of the Income Tax Bill 2025 & will likely come into effect from the next financial year. The CBDT is working on the procedural framework & the final design of the form.

Until the new rule is live, taxpayers must continue to follow the existing ITR filing process for refunds."

🌐 Final Thoughts

This move by the government is a step forward in making India’s tax system more efficient and taxpayer-friendly. By allowing late ITR filers to claim TDS refunds and potentially eliminating the ITR requirement for certain cases, it aligns with the broader vision of “Ease of Doing Business.”
